প্রতারণা ও জালিয়াতির মাধ্যমে ফারমার্স ব্যাংকের (বর্তমানে যা পদ্মা ব্যাংক) চার কোটি টাকা আত্মসাত করার অভিযোগে করে মামলায় সাবেক প্রধান বিচারপতি সুরেন্দ্র কুমার সিনহার ১১ বছরের কারাদণ্ড হয়েছে। মঙ্গলবার রাজধানী ঢাকার বিশেষ জজ আদালত-৪-এর বিচারক শেখ নাজমুল আলমের আদালত এ আদেশ দেন। দেশের ইতিহাসে এই প্রথম বারেরমত সাবেক কোনো প্রধান বিচারপতির ফৌজদারি মামলায় সাজা হলো ।

রায়ে অর্থ পাচার করার মামলায় সিনহাকে সাত বছর কারাদণ্ড দেয়া হয়েছে। আর জরিমানা করা হয়েছে ৪৫ লাখ টাকা । তারসাথে অর্থ আত্মাসাতের দায়ে চার বছর কারাদণ্ড এবং ৫০ হাজার টাকা জরিমানা করা হয়েছে।

তবে আদালত জানিয়েছে, দুটি শাস্তি একসাথে শুরু হওয়ায় সিনহাকে কারা ভোগ করতে হবে সাত (৭ ) বছর। পাশাপাশি তার ব্যাংক হিসেবে গচ্ছিত ৭৮ লাখ টাকা রাষ্ট্রীয় কোষাগারে জমা দেয়ার নির্দেশ দিয়েছে আদালত।

কারাদণ্ডপ্রাপ্ত অপর আসামিরা হলেন- ফারমার্স ব্যাংকের (বর্তমান পদ্মা ব্যাংক) সাবেক এমডি এ কে এম শামীম, ফারমার্স ব্যাংকের (বর্তমান পদ্মা ব্যাংক) সাবেক অডিট কমিটির চেয়ারম্যান মাহবুবু হক চিশতী, সাবেক এসইভিপি গাজী সালাহউদ্দিন, ফার্স্ট ভাইস প্রেসিডেন্ট স্বপন কুমার রায়, ফার্স্ট ভাইস প্রেসিডেন্ট সাফিউদ্দিন আসকারী, ভাইস প্রেসিডেন্ট মো. লুৎফুল হক, রনজিৎ চন্দ্র সাহা ও তার স্ত্রী সান্ত্রী রায়। এদের মধ্যে এমডি এ কে এম শামীমের চার বছরের কারাদণ্ড ও বাকি আসামিদের তিন বছর করে কারাদণ্ড দিয়েছেন আদালত।

টাঙ্গাইলের বাসিন্দা মো. শাহজাহান ও তারসাথে এলাকার বাসিন্দা নিরঞ্জন চন্দ্র সাহার বিরুদ্ধে অভিযোগ প্রমাণিত না হওয়ায় তাদের বেকশুর খালাস দেয়া হয়েছে।

এর আগে গত বৃহস্পতিবার দিন (২১ অক্টোবর ) ঢাকার বিশেষ জজ আদালত-৪-এর যার বিচারক শেখ নাজমুল আলমের আদালতে মামলার রায় ঘোষণার জন্য দিন ধার্য করা ছিল । বিচারক এ দিন রায় ঘোষণা না করে , ৯ নভেম্বর পরবর্তী রায় ঘোষণার জন্য দিন ধার্য করে ।

গত ৫ অক্টোবর ঢাকার বিশেষ জজ আদালত-৪-এর ভারপ্রাপ্ত বিচারক আলী হোসেন রায় ঘোষণার জন্য এ দিন ধার্য করে । । কিন্তু বিচারক শেখ নাজমুল আলম অসুস্থ থাকায় তারিখ পিছিয়ে পরবর্তী রায় ঘোষণার জন্য ২১ – অক্টোবর দিন ধার্য করে।

১৪ই সেপ্টেম্বর রাষ্ট্র ও আসামিপক্ষের যুক্তিতর্ক উপস্থাপন শেষে রায় ঘোষণার জন্য ৫ই অক্টোবর দিন ধার্য করেছিলেন একই আদালত।

মামলার আসামিদের মধ্যে কারাগারে রয়েছেন মাহবুবুল হক চিশতী । এবং বাকি ছয়জন জামিনে।

অপরদিকে সুরেন্দ্র কুমার সিনহা, রণজিৎ চন্দ্র সাহা ও তার স্ত্রী সান্ত্রী রায় সাথে ফারমার্স ব্যাংকের ফার্স্ট ভাইস প্রেসিডেন্ট সফিউদ্দিন আসকারী আহমেদ, পলাতক রয়েছেন। পলাতক থাকায় তারা আত্মপক্ষ সমর্থন করতে পারেন নি। এ মামলায় সাক্ষী দিয়েছেন ২১- জন।

ফারমার্স ব্যাংক থেকে চার ( ৪ ) কোটি টাকা ব্যক্তিগত ব্যাংক অ্যাকাউন্টে স্থানান্তর ও আত্মসাৎ করার অভিযোগে ২০১৯ সালের ১০ ই জুলাই এস কে সিনহাসহ ১১ -জনের বিরুদ্ধে মামলা করে – দুর্নীতি দমন কমিশন (দুদক)। দুদকের সমন্বিত জেলা কার্যালয়, ঢাকা-১-এ মামলা করা হয়। মামলার বাদি দুদকের পরিচালক সৈয়দ ইকবাল হোসেন। আসামিদের বিরুদ্ধে ঋণ জালিয়াতি ও চার (৪ ) কোটি টাকা আত্মসাতে জড়িত থাকার অভিযোগ আনা হয়।

এরপর একই বছরের ১০ই ডিসেম্বর আদালতে এস কে সিনহাসহ ১১ – জনের বিরুদ্ধে অভিযোগপত্র জমা দেন মামলার তদন্তকারী কর্মকর্তা দুদকের পরিচালক বেনজীর আহমেদ। ২০২০ সালের ১৩ই আগস্ট ঢাকার বিশেষ জজ আদালত-৪ এর বিচারক শেখ নাজমুল আলম এস কে সিনহাসহ ১১ জনের বিরুদ্ধে অভিযোগ গঠন করেন।
